Supreme Court Clarifies 24-Hour Rule for Detention and Arrest
The Supreme Court ruled that the 24-hour period for producing a detainee before a magistrate begins when liberty is curtailed. This decision, announced on Thursday, rejects attempts by some high courts to differentiate between detention and arrest, stating that no buffer period exists. The ruling arose from a case involving four individuals detained under the Narcotic Drugs and Psychotropic Substances Act after the seizure of 11.03 kg of yaba tablets in Tripura. They were detained on September 29, 2025, at 2 pm but were only formally arrested the next day at 11 am. The court held that their continued detention violated Article 22(2) and mandated their immediate release, reinforcing the constitutional protection against prolonged custody.
