Allahabad High Court Revises Maintenance Amount for Divorced Woman
The Allahabad High Court has clarified that the 25% maintenance guideline for divorced women is not mandatory. In a recent ruling, the court increased a woman's monthly maintenance from Rs 12,000 to Rs 20,000, emphasizing that courts should determine maintenance based on individual circumstances. The court noted that the husband had a gross salary of Rs 86,674, with Rs 67,043 credited after deductions. The ruling came during the review of two petitions involving the maintenance claim and the husband's challenge to the initial award. The court stated that a decree of divorce does not prevent a wife from claiming maintenance if she is unable to support herself and has not remarried.
