Supreme Court Seeks Centre's Response on Data Protection Law Challenge

The Supreme Court has issued a notice to the Centre regarding a Public Interest Litigation (PIL) that challenges provisions of the Digital Personal Data Protection Act, 2023. The PIL, filed by 'Mazdoor Kisan Shakti Sangathan' and activists, claims that Section 44 of the Act undermines transparency mandated by the Right to Information Act, 2005. The court has directed the Ministry of Personnel, Public Grievances and Pensions and the Ministry of Law and Justice to respond. The petitioners seek to restore the original Section 8 of the RTI Act and ensure that proactive disclosure requirements remain unaffected by the new law. The Rajasthan government has also been included in the proceedings.
