Government Seeks Clarification on Supreme Court's OBC Reservation Ruling
The Supreme Court of India will consider the Centre's application for clarification regarding its March 11 ruling on the income test for the OBC creamy layer exclusion criteria. The Union government stated that implementing the ruling retrospectively is 'extremely difficult' and may lead to widespread contestations from candidates denied Non-Creamy Layer certificates since 2012. The March judgment directed the creation of supernumerary posts for OBC candidates affected by the income test misapplication. The Department of Personnel and Training has raised concerns about potential impacts on seniority and fairness across categories. The Centre has also requested to continue using the old income test interpretation for the upcoming CSE 2025 candidates, while the Supreme Court will assess these requests in an upcoming session.
