Supreme Court Reviews POSH Act Applicability for Women Lawyers
The Supreme Court has requested responses from the Centre and Bar Council of India regarding a petition from the Supreme Court Women Lawyers Association. The petition challenges a Bombay High Court ruling stating that women advocates cannot file sexual harassment complaints with state bar councils, as no employer-employee relationship exists. The petition argues this decision creates a significant gap in redressal mechanisms under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. The Supreme Court has previously mandated the establishment of internal complaints committees to address such grievances. The ongoing case raises critical questions about the relationship between lawyers and bar councils in the context of workplace harassment laws.
