Delhi Court Discharges UK National, Frames UAPA Charges in Protest Case

A Delhi court discharged Inderpal Singh Gaba, a UK national, from charges of insulting the Indian national flag during protests outside the Indian High Commission in London in March 2023. The court ruled that the Prevention of Insults to National Honour Act, 1971 does not apply to actions taken on foreign soil. However, Gaba faces charges under the Unlawful Activities (Prevention) Act (UAPA) for his alleged participation in protests where pro-Khalistan slogans were raised. The National Investigation Agency (NIA) linked these protests to incidents involving the assault of security personnel and the attempted hoisting of a Khalistani flag. Gaba was arrested at the Attari border on April 25, 2024, and his defence plans to challenge the court's ruling in a higher court.
