Supreme Court Sets New Standards for Death Penalty Sentencing

The Supreme Court of India has ruled that capital punishment can only be imposed when a convict's reformation is deemed impossible. A bench comprising Justices Vikram Nath, Sandeep Mehta, and Vijay Bishnoi stated that the prosecution must prove that life imprisonment is insufficient as an alternative. This ruling came as the court commuted a death sentence for a man convicted of murdering his six-year-old stepdaughter in 2018, citing the need to consider mitigating factors such as the convict's background and conduct in custody. The court found that the prosecution failed to demonstrate the convict's irredeemability. The revised sentence mandates imprisonment for life without remission, emphasizing the importance of preserving the possibility of reformation.
