Supreme Court Rules on Mediated Settlements in Matrimonial Disputes
The Supreme Court ruled that parties in matrimonial disputes cannot withdraw from mediated settlements after accepting benefits without valid reasons. The court stated that such agreements, once authenticated by a mediator, bind both parties. In a recent case, a wife attempted to initiate domestic violence proceedings after withdrawing from a settlement where the husband agreed to pay ₹1.5 crore and return jewellery. The court disapproved of her claims regarding undisclosed financial aspects and emphasized the importance of upholding legal agreements. Ultimately, the Supreme Court granted divorce, citing an irretrievable breakdown of the marriage, and quashed the domestic violence proceedings against the husband and mother-in-law.
